By becoming a Client of Careerient, LLC, DBA Five Strengths Career Transition Experts, you are choosing a highly customized and personal career assistance service. The services provided are focused on delivering career documentation, including but not limited to resumes and cover letters.

TERMS AND CONDITIONS
The client agrees that Five Strengths Career Transition Experts cannot be responsible for changing market conditions, job posting changes or a client’s own aggressiveness, attitude and willingness to implement their action plan. Ultimately a client’s success in the job market is solely his or her responsibility. The client is solely responsible for proofing and acceptance. Satisfaction is assumed upon acceptance of documents. Client decision to address a new employment target not discussed in initial purchase agreement will result in additional fees. After acceptance of a final draft, any changes will incur a new fee.

RESUME CONSULTATION:
The client agrees that if he/she is having a resume prepared by us that he/she will complete an online career history intake or telephone consultation (type of consultation determined by product(s) purchased). The consultation is a meeting of approximately one to two hours with the resume writer to discuss the client’s career history and career goals in depth. The online process is a series of online modules to be completed by the Client on Client’s own time. The Client is solely responsible for the integrity and verifiability of the information provided during this interview and throughout the document preparation process.

CAREER COACHING:
The client agrees that the coach is responsible for guiding each session and creating an environment that maximizes the client’s opportunity for self-awareness and personal growth, but the client, not the coach, has ultimate responsibility for any results. The client hereby commits to a coaching partnership to help him/her achieve defined personal and professional goals. The client understands that he/she is responsible for his/her own decisions and any changes that occur are a function of his/her commitment to the relationship and the coaching process. The client agrees that information about the client’s career transition shall be shared as necessary for the client’s career transition with other representatives of Five Strengths Career Transition who work directly or indirectly with the client. The Client is solely responsible for the integrity and verifiability of the information provided during this interview and throughout the career coaching process.

FEES FOR SERVICE:
Fees for services are due in advance of inception of services. Fees paid are valid for services for 1 year from date of payment; services paid for but not scheduled within 365 days might be subject to the difference between the fees paid and standard fees published at that time and be considered credit paid toward any services requested after 365 days from date of initial service.

Any services requested that are outside the scope of this agreement are not included in this fee and are to be separately negotiated.

Payment is accepted via PayPal with project order. Fees are not refundable once first drafts are delivered via email. Refunds may be requested within seven (7) business days of agreement to these terms, so long as no formal consultations or access to proprietary site have been completed. Any money owed to the client will be refunded in the form of a PayPal refund from Five Strengths Career Transition Experts. Any refund will be paid to the client within 30 days of the receipt of the cancellation notice. No refunds will be paid later than 6 months from date of purchase.

TIME FRAME FOR DOCUMENT DELIVERY:
Standard turnaround time for first drafts of a resume and cover letter pair is 5 business days after the Career Inventory Conversation or 5-10 days after completion of online career inventory. Additional dependent documents will have their own schedule and be established between Five Strengths Career Transition Experts and the Client.

DOCUMENT FORMATS:
Documents will be delivered to Client using Microsoft Office using standard Word format, PDF, and, as requested, .txt. Five Strengths Career Transition Experts cannot guarantee the compatibility of computer files with client systems or that documents will retain their original formatting features. Five Strengths Career Transition Experts does not provide technical support on document formatting and cannot guarantee system compatibility or the successful transfer of formatting features.

DOCUMENTS AS REPRESENTATIVE SAMPLES OF FIVE STRENGTHS CAREER TRANSITION’S CUSTOMARY DELIVERABLES:
From time to time, Five Strengths Career Transition Experts uses anonymized documents prepared in the course of business with clients as print and electronic examples of customary deliverables, competitions, presentations, on the Five Strengths web site, and similar. Five Strengths hereby requests that the Client give permission for it to use the Client’s portfolio, completely anoymized for confidentiality, in this way. Client must select either YES (may use) or NO (may not use) on the intake / scheduling to indicate permission. Client may revoke permission at any time (unless materials have been published in print).

COMPLETION OF SERVICE:
All document preparation will be considered complete 15 days subsequent to final day of last paid month of coaching or 30 days subsequent to date of career inventory call, whichever is latest. All monthly sessions must be completed within a 30-day timeframe. Sessions may not be rolled over into future months.

APPOINTMENT CANCELLATION POLICY:
Client will demonstrate preparation for each appointment by delivering completed worksheets and/or preparatory work at least 24 hours in advance of appointment. Client’s failure to do so will result in, at Five Strengths’ discretion, cancellation of the appointment without opportunity to reschedule. Client and Five Strengths team may reschedule any appointment up to 24 hours prior to it without penalty. Emergency reschedules will be considered on a case-by-case basis.

NOTICE TO CLIENT

NO PROMISE OR GUARANTEE OF ANY EMPLOYMENT IS EXPRESSLY MADE OR IMPLIED UNDER THE TERMS OF THE CONTRACT. Five Strengths Career Transition Experts, is licensed and operates under the laws of Utah. It is agreed that the terms of this contract are governed by the laws of the state of Utah, and that any legal action brought by either party to enforce the terms set forth herein shall be brought in a court of competent jurisdiction within the state of Utah, County of Salt Lake.

LIABILITY
Client acknowledges that Five Strengths Career Transition Experts’s liability is limited to the fees paid for service(s) rendered.

Unenforceability. If any provision or provisions of this Agreement shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

Confidentiality. The Client agrees not to disclose to any third party the terms of this Agreement and any other information provided by Five Strengths Career Transition Experts or designated as confidential (“Confidential Information”) and also agrees not to use any Confidential Information of Five Strengths Career Transition Experts, or any other information, whether it is marked confidential or not, unless expressly permitted under this Agreement or except with the prior written consent of Five Strengths Career Transition Experts. The Client agrees to exercise the highest degree of care in safeguarding any Five Strengths proprietary information or Confidential Information against loss or other inadvertent disclosure.

Five Strengths agrees not to disclose any Client information to any third parties without express permission of Client. In cases when Client meets with a Five Strengths career coach prior to working with a resume writer, Five Strengths may ask Client’s permission to enable Client’s career coach and resume writer to collaborate in the interest of the Client for the purposes of the Client’s career transition.

Assignment of Warranty; Disclaimer. FIVE STRENGTHS CAREER TRANSITION EXPERTS, MAKES NO REPRESENTATION OR WARRANTY REGARDING ITS SERVICE AND THE SERVICE IS FURNISHED TO CLIENT “AS IS.” FIVE STRENGTHS CAREER TRANSITION EXPERTS, SPECIFICALLY EXCLUDES AND DISCLAIMS ALL WARRANTIES OR REPRESENTATIONS CONCERNING THE SERVICES COVERED BY THIS AGREEMENT, INCLUDING IN PARTICULAR ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY OF NONINFRINGEMENT OF A THIRD PARTY’S INTELLECTUAL PROPERTY RIGHTS WITH RESPECT TO THE SERVICE.

Limitation of Liabilities. IN NO EVENT WILL FIVE STRENGTHS CAREER TRANSITION EXPERTS, BE LIABLE TO CLIENT OR TO ANY THIRD PARTY FOR INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, ARISING OUT OF OR OTHERWISE RELATING TO THE SERVICES OR THE USE OR PERFORMANCE OF THE SERVICE, EVEN IF FIVE STRENGTHS CAREER TRANSITION EXPERTS, HAS BEEN ADVISED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, IN NO EVENT SHALL THE LIABILITY OF FIVE STRENGTHS CAREER TRANSITION EXPERTS, TO CLIENT FOR ANY CLAIM WHATSOEVER RELATED TO THE SERVICE OR THE SERVICES OR ANY ORDER OR THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, ANY CAUSE OF ACTION SOUNDING IN CONTRACT, TORT OR STRICT LIABILITY, EXCEED THE PURCHASE PRICE RECEIVED BY FIVE STRENGTHS CAREER TRANSITION EXPERTS

Survival of Provisions. The provisions of Sections (Terms and Fees) hereof shall survive termination of this Agreement for whatever cause, including, but not limited to the mutual agreement to terminate this Agreement by both parties hereto.
